By browsing our website or using our platforms, interactive tools (including our pricing calculators and our AI-based conversational assistant), or services, you acknowledge that you have read and understood this Policy, and you agree that your personal information will be managed in accordance with it, where applicable.

This Policy is drafted in accordance with Quebec’s Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1, as amended by Law 25), the federal Personal Information Protection and Electronic Documents Act (PIPEDA), and the guidance issued by the Commission d’accès à l’information du Québec (CAI).

Purpose of the Privacy Policy

This Privacy Policy is intended to inform our users about how we collect, use, communicate, and protect their personal information.

To guarantee this protection, Excavation Chanthier ensures that it obtains an individual’s consent before collecting, processing, and disclosing personally identifiable information, except where law permits or requires us to act without consent.

The reasons and methods by which Excavation Chanthier, or anyone acting on its behalf, will manage your personal information are explained in this Policy. It is written in plain language to ensure full understanding and informed consent on the part of users.

The Privacy Officer is responsible for ensuring compliance with and implementation of this Policy. Any request relating to your personal information (access, rectification, withdrawal of consent, portability, de-indexation, complaint) must be addressed to them.

Methods of obtaining consent

We ensure that we obtain consent before collecting personal information from anyone. Such consent is manifest, free, informed, and given for specific purposes. It may be express or implied, and may be given either by the individual themselves or by an authorized representative.

We request express consent — orally, electronically, or in writing — for any collection of sensitive information or for any secondary purpose. However, implied consent may be inferred from an individual’s actions or inactions when reasonable in the circumstances. For example, providing a name and telephone number through our quote form to obtain a price estimate is perceived as implied consent to the collection of that information for the purpose of processing the request.

In determining the type of consent required, we assess the nature of the personal information, the purpose for which it is collected, and the reasonable expectations of an individual in a similar situation.

If we intend to use personal information for another purpose not specified at the time of collection, we will specify this new purpose and consent will be sought again.

You may withdraw your consent at any time, subject to legal or contractual restrictions, by contacting the Privacy Officer (above).

In certain situations, such as a government request or legal obligation, it may not be possible to obtain an individual’s consent to process their personal information. We will never share personal information outside the terms of this Policy except as required or permitted by law.

Personal information collected

Excavation Chanthier may collect personal information in a variety of ways, but always lawfully and only for clearly stated purposes, as set out in this Policy, or where permitted or required by law.

The personal information we collect, and its level of sensitivity, may differ depending on the nature of your interactions with Excavation Chanthier (visiting the site, submitting a quote form, using the French drain pricing calculator, conversing with our AI-based assistant, requesting a PDF estimate, etc.). It is therefore essential for us to clarify which information we use.

We take care to protect all personal information collected. We pay particular attention to data such as:

  • Contact information and identity: First name, last name, email address, mailing address, city, telephone number, and other similar information used to communicate with you and prepare a quote.
  • Quote data (French drain calculator): Drain length in linear feet, foundation type (poured concrete or block), selected options (limited maneuver space, crack repair, window wells, retention basin with pump), total estimated amount in CAD, and SHA-256 cryptographic fingerprint of the generated PDF estimate.
  • Conversations with our AI assistant (“Custom GPT”): The text content of messages you send to our AI-based conversational assistant hosted with OpenAI, used to generate French drain price estimates.
  • Intent capture via the Custom GPT (“intent lead”): When you provide your first name, last name, email, and phone number to our conversational assistant — even before you have completed a quote or received a PDF estimate — those contact details, together with a textual summary of your intent (“intent text”: a free-form description of the need you expressed to the assistant, for example the type of project or the geographic area concerned), are transmitted to our customer relationship management system (LeadConnector / HighLevel) so that a representative can follow up with you.
  • Credentials: Passwords, secret questions/answers, and similar information to secure access to your account (where applicable).
  • Demographic data: Information such as your age, gender, country, and preferred language (where voluntarily provided).
  • Subscriptions: Information about your subscriptions to our communications.
  • Browsing: Data related to your use of our websites and tools. This includes data that you provide or that is generated by your interactions and the history of your communications with our team (IP address, browser type and version, pages visited, dates and times, session duration).
  • Support: Information provided in response to requests for assistance.
  • Preferences: Information about your tastes and interests, inferred or provided directly.
  • Inputs: Textual or handwritten data and related information.
  • Other data: Additional information collected during your browsing.

Data processing purposes

We and our partners use technologies that collect information from your device to improve our offerings and deliver advertising and content tailored to your preferences. You may accept or decline some of these functionalities.

  • Essential and security: We use technologies and cookies that are essential to ensure the optimal operation and security of our online services. They cannot be deactivated. They help us and our partners to secure your connection by recording your identification information, adapting your interface (e.g. choice of language), reducing fraudulent form submissions, and storing your preferences regarding the use of technologies that collect your information.
  • Experience analysis and optimization: The data collected by these technologies plays a crucial role in continuously enriching your browsing experience. It helps us understand how you interact with our online services and evaluate traffic on our platforms by generating statistics. You may revoke your consent to the use of these technologies at any time.
  • Marketing and advertising: This data helps us and our partners record the links you click and the pages you visit on our online platforms. This enables us to better identify your preferences and suggest tailored offers and services. You may revoke your consent at any time.
  • Generation of price estimates: When you use our French drain calculator or our AI-based conversational assistant, your inputs are used to compute a price estimate and, where applicable, to send you a summary PDF by email.
  • Customer relationship management (CRM): Contact details and quote data submitted through our forms — including intent leads captured by our Custom GPT before any quote has been completed — are recorded in our customer relationship management system to enable commercial follow-up.

Data collection objectives

The data we collect aligns with the purposes and objectives stated in our Privacy Policy.

Here are the reasons why your personal information is collected:

  • To provide a service: We collect and process the information required to meet our commitments (price estimates, scheduling appointments, performing excavation and French drain installation work) and respect our contractual agreements.
  • To optimize and enhance our products and services: Information obtained from your use of our services may be used to evaluate and improve our offerings.
  • To offer personalized products and services: Collecting and analyzing data from your interactions with our services guides us in tailoring our products and services.
  • To guarantee the confidentiality of our customers: The information we collect helps us confirm identity and maintain the confidentiality of those who interact with us.
  • To meet legal requirements: We collect data to comply with obligations arising from legislation, regulations, or international agreements.

Treatment processes used

Excavation Chanthier is committed to protecting your personal information and to processing it in accordance with industry standards and norms, solely for the purposes for which it was collected, as stipulated in this Policy or any other specific notice. We implement technical measures (TLS encryption in transit, access controls, logging) and organizational measures (training, access restricted to a need-to-know basis) to protect your information.

However, given the security risks associated with transmission over the Internet, total protection of such data cannot be guaranteed. Therefore, any information you transmit to us is sent at your own risk.

How to access and manage your personal information

Excavation Chanthier ensures that the personal information it holds is as accurate, up-to-date, and complete as is necessary for the purposes for which it is to be used.

You have the right to request access to your personal information to verify it and to request rectification if it proves to be inaccurate. If you believe that your data is inaccurate, or if you wish to consult your information, you can send a request to the Privacy Officer using the contact details provided above.

We will endeavor to provide you with access to your data within 30 days of receipt of the request, in accordance with Law 25. For security reasons, we may need to confirm your identity before responding.

There may also be situations where we are unable to provide you with access to your information — for example, if this would involve disclosing the personal information of another person who has not given consent, or if there are legal constraints on such disclosure. If this is the case, we will inform you in writing of the reasons for our refusal and of the recourses available to you.

Your rights under Law 25

As a Quebec resident, you benefit from the following rights with respect to your personal information:

  • Right of access (s. 27): Obtain communication of the personal information we hold about you.
  • Right of rectification (s. 28): Have inaccurate, incomplete, or equivocal information rectified.
  • Right to withdraw consent (s. 14): Withdraw your consent at any time to the collection, use, or communication of your information, subject to legal or contractual restrictions.
  • Right to data portability (s. 84, in force since September 22, 2024): Obtain, in a structured and commonly used technological format, the computerized personal information you have provided to us, or require that it be communicated to a third party.
  • Right to cessation of dissemination, de-indexation, and re-indexation (s. 28.1): Require the cessation of dissemination of personal information about you or the de-indexation of any hyperlink giving access to it, where such dissemination contravenes the law or an order, or causes serious injury.
  • Right regarding automated decisions (s. 12.1): Be informed when a decision is based exclusively on automated processing, know the personal information and the principal factors that led to the decision, and submit observations.

Sharing and reasons for sharing personal information with third parties

Excavation Chanthier does not disclose your personal information to companies, organizations, or individuals outside of Excavation Chanthier, except to our authorized suppliers and processors who require access to such information for the purposes stated in this Policy, and in compliance with its provisions, as well as in the following situations:

  • With your consent.
  • For storage on servers, in which case your information may be routed through other jurisdictions. We only use reputable companies with robust privacy policies.
  • For external processing purposes: We entrust your information to trusted companies or individuals to process it on our behalf, according to our guidelines, in compliance with this Policy, ensuring data protection at least as stringent as our own.
  • For legal reasons: We share your information outside our company if necessary to comply with established laws and regulations or if ordered by a court.

Excavation Chanthier will not sell or rent your personal information to third parties.

Transfer of personal information outside Quebec

In accordance with section 17 of Law 25, we inform you that the communication of personal information to several of the suppliers listed above involves a transfer outside Quebec, principally to the United States and, in some cases, to the European Union.

Before any transfer, we conduct a privacy impact assessment (PIA) to verify that the information communicated benefits from adequate protection, including through:

  • contractual clauses imposing confidentiality and security obligations;
  • an assessment of the legal regime applicable in the destination territory;
  • technical measures (encryption in transit and at rest, access controls).

You may obtain a summary description of the assessment performed for a given supplier by contacting the Privacy Officer.

By using our services, you expressly consent to this international transfer of personal information.


Decisions based exclusively on automated processing

In accordance with section 12.1 of Law 25, we inform you that our French drain pricing calculator and our AI-based conversational assistant produce price estimates generated entirely automatically based on the inputs you provide (drain length, foundation type, options).

These estimates are indicative and non-contractual: no legal or contractual decision is taken solely on the basis of this automated processing. A human representative of Excavation Chanthier validates every quote before it becomes contractual.

The principal factors and parameters used by our calculator are published in the “Calculation details” section of the PDF estimate we send you. On request, we can provide you with additional information on how the model operates. You may also submit observations to a member of our team before the signing of any contract.

If you prefer not to be subject to automated processing, you may contact us directly by phone or email to obtain a manually prepared quote.

Specifics of the Custom GPT hosted by OpenAI. When you interact with our conversational assistant via the OpenAI platform (ChatGPT), your inputs are first processed by OpenAI’s servers in the United States. OpenAI, through the “OpenAI Actions” mechanism, then initiates outbound calls from its own servers to our REST infrastructure to compute an estimate, generate a PDF, or record an intent lead. OpenAI does not act solely as a display channel: it is an active processor making server-to-server calls to our systems on your behalf. This interaction involves a transmission of your personal information from OpenAI to our hosting infrastructure (Hostinger, EU) and to our CRM (LeadConnector, United States).

Opt-out option. If you prefer that your inputs not transit through OpenAI, you may at any time use our French drain pricing calculator directly on the website: excavationchanthier.ca/en/excavation/french-drain/french-drain-cost/ instead of going through the Custom GPT. The web calculator does not route any data to OpenAI.

Retention of personal information and retention periods

Excavation Chanthier retains the information it collects for specific periods, depending on the type and the purpose of collection. Throughout this retention period, Excavation Chanthier implements physical, technical, and organizational measures to ensure the security and accuracy of personal information.

After the end of the applicable retention period, personal information is destroyed or irreversibly anonymized.

Cookies and profiling technologies

With your consent, Excavation Chanthier may use cookies, web beacons, pixels, log files, or other technologies to collect specific personal information about visitors to our websites, as well as recipients of our newsletters, invitations, and other communications. Cookies are data sent by the server to the browser when a site is visited, making it possible to uniquely identify the current session. This information may include details such as your IP address, browser type and version, the pages of our site you visit, the date and time of your visit, the duration of your session, and other statistics.

In accordance with section 8.2 of Law 25, profiling functions that allow a person to be identified, located, or tracked are deactivated by default. You may enable or disable them at any time via the consent management banner present on the site.

Please note that our website may contain links to third-party websites. Our Privacy Policy no longer applies once you leave our site. Excavation Chanthier is not responsible for the collection or processing of personal information by these third parties or via these external sites.

Privacy incident

In accordance with section 3.5 of Law 25, in the event of a privacy incident (unauthorized access, use, or communication, or loss of personal information), Excavation Chanthier will promptly take reasonable measures to reduce the risk of harm and prevent recurrence. If the incident presents a risk of serious harm, we will notify the affected individuals and the Commission d’accès à l’information du Québec, and will maintain a register of incidents in accordance with the law.

Entry into force

This Policy enters into force on April 27, 2026.

This Policy replaces the previous version dated October 1, 2024. Excavation Chanthier reserves the right to amend this Policy at any time. Any material change will be announced on our website. We invite you to review it regularly.
